Welcome to Botanic Mate. These Terms of Service ("Terms") govern your access to and use of the Botanic Mate mobile application ("App") provided by Aleksandr Urzhumtsev ("we," "us," or "our").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By using the App, you represent that:

• If you are under the age of 18, you have obtained parental or guardian consent to use the App and make any purchases.
• You will comply with all applicable laws and regulations when using the App.

2. Description of Service

Botanic Mate provides AI-powered plant identification and plant care information services. The App allows you to:

• Photograph plants and receive AI-generated identification results.
• Access information about plant care, characteristics, and properties.
• Maintain a virtual garden to track your plants.
• Receive information about plant toxicity for humans and pets.
• Receive information about potential allergy risks, triggers, and pollen levels.

3. Account, Data, and Device Identifier

The App does not require you to create an account with a username or password. Instead, the App assigns an anonymous device identifier to your installation, which is used to link your scan history, garden data, and subscription access.

5. User Responsibilities

When using the App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms.
• Not rely solely on the App for plant identification or safety decisions.
• Exercise your own judgment and due diligence regarding any plant.
• Not use the App to identify plants for commercial purposes without our consent.
• Not attempt to reverse engineer, decompile, or extract the source code of the App.
• Not interfere with or disrupt the App's functionality or servers.
• Not upload malicious content, viruses, or harmful code.
• Not use the App in any way that could harm others or damage our reputation.

6. User Content

You retain ownership of photos and content you submit through the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content for the purpose of providing and improving the App's services.

You represent that any content you submit:

• Does not infringe on any third party's intellectual property rights.
• Does not contain illegal, harmful, or offensive material.
• Is not false, misleading, or fraudulent.

7. Subscriptions and Payments

7.1 In-App Purchases

The App may offer premium features through subscription plans or one-time purchases. Purchases are processed through Google Play (for Android) or the Apple App Store (for iOS).

7.2 Subscription Terms

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions through your Google Play or App Store account settings.
• Prices are subject to change. We will notify you of any price changes before they take effect.

7.3 Refunds

Refund requests are handled by Google Play or the Apple App Store according to their respective policies. We do not directly process refunds. Please contact the respective app store for refund inquiries.

7.4 Platform-Specific Subscriptions

Subscriptions purchased through the App are tied to the platform and store account through which they were originally made. A subscription purchased on iOS (Apple App Store) does not grant access to premium features on Android (Google Play), and vice versa. Each platform operates independently, and subscriptions are not transferable or synchronized between platforms. If you use the App on multiple platforms, a separate subscription is required for each.

7.5 Consent to Share Consumption Data with Apple

By using the App and making in-app purchases through the Apple App Store, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. Such data sharing is carried out in compliance with Apple's policies and only as necessary to process your requests. 8. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works of the App.
• Use our trademarks, logos, or branding without permission.
• Remove any copyright or proprietary notices from the App.

You agree to indemnify, defend, and hold harmless Aleksandr Urzhumtsev and any affiliates, officers, agents, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any applicable laws or regulations.
• Any content you submit through the App.
• Your reliance on plant identification or information provided by the App.

By using the App, you expressly acknowledge and assume all risks associated with:

• Relying on AI-generated plant identification results.
• Acting upon information about plant toxicity, edibility, allergy risks, or properties.
• Any interaction with plants based on information from the App.

You understand that incorrect plant identification can result in serious injury or death if toxic plants are consumed or handled improperly.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including but not limited to:

• Violation of these Terms.
• Conduct that we believe is harmful to other users or to us.
• Technical or security reasons.

You may stop using the App at any time by uninstalling it from your device.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or through other communication channels. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

15. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts in accordance with applicable jurisdictional rules.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and understandings.
