Welcome to Botanic Mate. These Terms of Use (also referred to as Terms of Service; collectively, the "Terms") govern your access to and use of the Botanic Mate mobile application (the "App") provided by Aleksandr Urzhumtsev ("we," "us," or "our").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By using the App, you represent that:

If you are under the age of 18, you have obtained parental or guardian consent to use the App and make any purchases.
You will comply with all applicable laws and regulations when using the App.

2. Description of Service

Botanic Mate provides AI-powered plant identification and plant care information services. The App allows you to:

Photograph plants and receive AI-generated identification results.
Access information about plant care, characteristics, and properties.
Maintain a virtual garden to track your plants.
Receive information about plant toxicity for humans and pets.
Receive information about potential allergy risks, triggers, and pollen levels.

CRITICAL DISCLAIMER - AI LIMITATIONS

THE APP USES ARTIFICIAL INTELLIGENCE TECHNOLOGY TO IDENTIFY PLANTS AND PROVIDE INFORMATION. AI SYSTEMS CAN AND DO MAKE MISTAKES. THE IDENTIFICATION RESULTS AND INFORMATION PROVIDED BY THE APP MAY BE INACCURATE, INCOMPLETE, OR INCORRECT.

You expressly acknowledge and agree that:

AI-generated plant identifications are not guaranteed to be accurate.
Information about plant toxicity, edibility, allergy risks, or safety may be incorrect.
You must independently verify any plant identification before consuming, touching, or otherwise interacting with any plant.
You should never eat, consume, or use any plant based solely on information from this App.
You should always consult qualified professionals (botanists, poison control centers, veterinarians, or medical professionals) for plant-related safety decisions.

3. Account, Data, and Device Identifier

The App does not require you to create an account with a username or password. Instead, the App assigns an anonymous device identifier to your installation, which is used to link your scan history, garden data, and subscription access.

Important: Your data is tied to your device.

If you clear the App's data through your device settings (e.g., Settings > Apps > Botanic Mate > Clear Data), your device identifier will be permanently deleted. This means you will lose access to your scan history, garden, and any data associated with your previous identifier.
If you uninstall and reinstall the App, your identifier may be restored automatically if your device has Google Auto Backup enabled. However, this is not guaranteed and depends on your device and Google account settings.
We cannot recover or restore a lost device identifier. Once deleted, the association between your device and your data on our servers cannot be re-established.

To reduce the risk of data loss, ensure that your Google account's backup feature is enabled in your device settings.

4. No Professional Advice

The App does not provide professional, medical, veterinary, or expert advice.

Information provided through the App:

Is for general informational and educational purposes only.
Should not be relied upon as professional botanical advice.
Should not be used as a substitute for consultation with qualified professionals.
Should not be the basis for any decisions regarding plant consumption, medical treatment, or pet safety.

If you suspect plant poisoning or have health concerns related to plant exposure, immediately contact emergency services, a poison control center, or seek medical/veterinary attention.

5. User Responsibilities

When using the App, you agree to:

Use the App only for lawful purposes and in accordance with these Terms.
Not rely solely on the App for plant identification or safety decisions.
Exercise your own judgment and due diligence regarding any plant.
Not use the App to identify plants for commercial purposes without our consent.
Not attempt to reverse engineer, decompile, or extract the source code of the App.
Not interfere with or disrupt the App's functionality or servers.
Not upload malicious content, viruses, or harmful code.
Not use the App in any way that could harm others or damage our reputation.

6. User Content

You retain ownership of photos and content you submit through the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content for the purpose of providing and improving the App's services.

You represent that any content you submit:

Does not infringe on any third party's intellectual property rights.
Does not contain illegal, harmful, or offensive material.
Is not false, misleading, or fraudulent.

7. Subscriptions and Payments

7.1 In-App Purchases

The App may offer premium features through subscription plans or one-time purchases. Purchases are processed through Google Play (for Android) or the Apple App Store (for iOS).

7.2 Subscription Terms

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage and cancel subscriptions through your Google Play or App Store account settings.
Prices are subject to change. We will notify you of any price changes before they take effect.

7.3 Refunds

Refund requests are handled by Google Play or the Apple App Store according to their respective policies. We do not directly process refunds. Please contact the respective app store for refund inquiries.

7.4 Platform-Specific Subscriptions

Subscriptions purchased through the App are tied to the platform and store account through which they were originally made. A subscription purchased on iOS (Apple App Store) does not grant access to premium features on Android (Google Play), and vice versa. Each platform operates independently, and subscriptions are not transferable or synchronized between platforms. If you use the App on multiple platforms, a separate subscription is required for each.

7.5 Consent to Share Consumption Data with Apple

By using the App and making in-app purchases through the Apple App Store, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. Such data sharing is carried out in compliance with Apple's policies and only as necessary to process your requests. 8. Intellectual Property and Use of Our Materials

The App and the BotanicMate website (botanicmate.com, including all of its subdomains and pages, the "Website"), together with all of their content and materials — including but not limited to text, plant descriptions, care guides, articles, catalog and encyclopedia entries, images, photographs, illustrations, graphics, logos, trademarks, icons, audio, video, layout, design, "look and feel," software, source code, databases, and the selection, coordination, structure, arrangement, and compilation of any data (collectively, the "Materials") — are owned by us or our licensors and are protected by copyright, database, trademark, and other intellectual property laws.

All use of the Materials is prohibited unless we have granted our prior written permission. Other than merely viewing the Website in a standard web browser for your own personal, non-commercial reference, you must not, by any means or technology, in any form, in whole or in part, directly or indirectly:

copy, reproduce, download, save, cache (beyond ordinary browser caching), print, duplicate, or store the Materials;
republish, post, display, mirror, frame, distribute, transmit, broadcast, syndicate, or otherwise make the Materials available to any third party;
modify, adapt, translate, or create derivative works based on the Materials;
sell, rent, lease, license, sublicense, or otherwise commercially exploit the Materials;
scrape, crawl, spider, harvest, extract, index, or otherwise collect the Materials by any automated or manual means, including bots, scripts, or data-collection tools;
use the Materials, in whole or in part, to develop, train, fine-tune, evaluate, benchmark, or improve any artificial intelligence, machine-learning, or large-language model, or for any text or data mining;
use the Materials to build, populate, train, or enrich any database, dataset, corpus, product, application, or service; or
remove, obscure, or alter any copyright, trademark, or other proprietary notice contained in or accompanying the Materials.

No license or right in or to the Materials is granted to you except as expressly and explicitly stated in these Terms. Any unauthorized use automatically terminates any permission to access the App or the Website, may infringe our rights and those of our licensors, and may violate applicable laws. We reserve all rights not expressly granted.

You may not use our trademarks, logos, or branding without our prior written permission. To request permission for any use of the Materials, contact us at support@botanicmate.com.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We expressly disclaim all warranties, including but not limited to:

Implied warranties of merchantability and fitness for a particular purpose.
Warranties that the App will be uninterrupted, error-free, or secure.
Warranties regarding the accuracy, reliability, or completeness of any plant identification or information provided.
Warranties that the App will meet your requirements or expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, LOSS OF DATA, OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF THE APP.
WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM RELIANCE ON PLANT IDENTIFICATION RESULTS OR INFORMATION PROVIDED BY THE APP, INCLUDING BUT NOT LIMITED TO POISONING, ALLERGIC REACTIONS, INJURIES, OR DEATH OF HUMANS OR ANIMALS.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aleksandr Urzhumtsev and any affiliates, officers, agents, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

Your use of the App.
Your violation of these Terms.
Your violation of any applicable laws or regulations.
Any content you submit through the App.
Your reliance on plant identification or information provided by the App.

12. Assumption of Risk

By using the App, you expressly acknowledge and assume all risks associated with:

Relying on AI-generated plant identification results.
Acting upon information about plant toxicity, edibility, allergy risks, or properties.
Any interaction with plants based on information from the App.

You understand that incorrect plant identification can result in serious injury or death if toxic plants are consumed or handled improperly.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including but not limited to:

Violation of these Terms.
Conduct that we believe is harmful to other users or to us.
Technical or security reasons.

You may stop using the App at any time by uninstalling it from your device.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or through other communication channels. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

15. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts in accordance with applicable jurisdictional rules.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and understandings.
